Srinagar, Mar 20: Court has framed charges against the two accused persons involved in the acid attack on a young girl in Srinagar that took place in February this year while the police are still pushing for the third accused to be treated as an adult.
In this regard, police said, on March 19, the charges were framed under Sections 120-B and 326-A of the India Penal Code (IPC) against the two adults accused of the heinous crime.
Soon after the investigation was completed, Srinagar police filed the charge sheet of the case on February 22—which was in a record time—against two adult accused in CJM court and against one accused who is a minor in the Juvenile Justice Board (JJB).
The incident took place on February 1 in the Hawal area of Srinagar after a girl aged 24 rejected the marriage proposal of the main accused, prompting him to carry out the heinous crime with the help of two other accomplices, of which one is a juvenile.
Further, the police said that the petition was filed in the JJB to try the juvenile as an adult in line with the amendments made in the Juvenile Justice Act, as police said, the accused falls in the bracket of 16-18 years and the nature of the crime is also heinous.
In response to the petition, a board has been constituted by JJB wherein assessment regarding his (accused) mental and psychological parameters is being conducted to decide if he can be treated as an adult in the trial.
Under the 326A of IPC, there is a mandatory minimum punishment of 10 years which may extend to imprisonment for life and, in either case, with a fine, while as under 120-B of IPC, the conviction can end up with imprisonment for life, or rigorous imprisonment for a term of two years or upwards.
The charges against the adults were framed by Principal Sessions Judge Srinagar, Jawad Ahmed against the two accused Sajid Altaf Rather (Sheikh) son of Muhamad Altaf Sheikh of Buchwara Dalgate, Srinagar, and Mohammad Saleem Kumar son of Abdul Gani Kumar of Dalgate (AP Padshahi Bagh), Srinagar.
“The next date of hearing has been fixed on 30. 03. 2022, police said.
Police in this regard has noted that the case is among the fastest charge-sheeted and charge-framed cases so far and both were completed within a month.
“Both the accused can be handed over the maximum punishment which is a life sentence, police said.
It is also to be noted here that Srinagar Police has also deputed a dedicated Pairavi officer of the rank of Inspector to follow the trial of the case in coordination with the Prosecution department, while as the trial of the case is being monitored by senior officers including SSP Srinagar.
Earlier, after initial treatment in Srinagar, the girl was flown to Chennai for further treatment, while the Administration has been bearing all the expenses of the family in this regard.
