Terms of Service
The agreement between you and BabyCheers. It's short, because the app is small and we'd rather you actually read it.
The short version. Your photos and words stay yours — we claim no ownership. Use BabyCheers for your own pregnancy and the people you invite. It is a celebration app, never medical advice. Because there are no accounts, your journey lives on your phone's identity: back it up with the transfer link before you change devices.
1. The agreement
These terms are a contract between you and BabyCheers covering the BabyCheers iOS app and this website. By using BabyCheers you accept them. If you don't, please don't use the app. Our Privacy Policy forms part of this agreement.
2. Who can use BabyCheers
You must be at least 13 years old, and at least 16 in countries where 16 is the minimum age to consent to an online service. Use BabyCheers for your own pregnancy, or as somebody invited to follow one. Don't create a journey about a person who hasn't asked you to.
3. Your identity is your device
BabyCheers has no accounts and no passwords. Your journey belongs to an anonymous identity created on your phone when you first open the app. This is a deliberate design choice, and it has one consequence worth stating plainly:
If you lose the phone or delete the app without transferring your journey first, that journey is gone. We cannot recover it, restore it, or prove it was yours, because we hold nothing that identifies you. Use Move to a new phone in the app before you change devices.
Anyone holding your phone can open your journey. Lock your device.
4. Your content stays yours
Your photos, videos, words, and dates are yours. We claim no ownership of any of it.
To run the app, you give us a limited licence to store your content, transmit it to the people you invite, and process it technically — resizing an image, generating a preview, keeping a backup. That licence exists only to operate BabyCheers for you. It ends when you delete the content. We do not use your content to advertise, we do not license it to anyone, we do not publish it, and we do not use it to train machine-learning models.
You are responsible for having the right to upload what you upload — including photographs of other people, and photographs taken by someone else.
5. What we ask of you
Don't use BabyCheers to:
- upload content you have no right to share, or that infringes someone's copyright or privacy;
- harass, threaten, or impersonate anyone, whether in a comment or a moment;
- upload unlawful content, including any sexualised imagery of a minor — this is the one thing we will report rather than merely remove;
- attempt to reach data belonging to journeys you weren't invited to, probe or interfere with our infrastructure, or work around the rules that keep a sealed answer sealed;
- scrape, resell, or build a competing service from the app or this site.

6. Not medical advice
BabyCheers is a celebration app. It is not a medical device, not a pregnancy tracker, and not a source of medical advice. Week numbers, size comparisons, and due dates in the app are ordinary calendar arithmetic offered for interest, and they are not a clinical assessment of anything.
Never use BabyCheers to make a decision about your health or your baby's, and never let it delay you in speaking to a doctor or midwife. If something worries you, contact a healthcare professional. In an emergency, call your local emergency number.
7. Availability and changes
We work to keep BabyCheers running, but we can't promise it will always be available or free of faults. We may change, suspend, or discontinue features. If we ever have to shut BabyCheers down, we'll give you reasonable notice and a way to export your moments and media before it goes.
We may update these terms. For material changes we'll notify you in the app or by updating the date at the top of this page before they take effect. Continuing to use BabyCheers after that means you accept the new terms.
8. Price
BabyCheers is currently free to use. If we introduce paid features in future, we'll make the price and what it covers clear before you're asked to pay, and anything you've already added will stay accessible to you.
9. Ending this agreement
You can stop at any time: delete your journey in the app, then delete the app. That ends this agreement. Delete the journey first — see section 3.
We may suspend or end your access if you break these terms, particularly section 5. Where it's reasonable to do so, we'll tell you why first.
10. Warranties and liability
BabyCheers is provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded by law.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for lost content or profits. Our total liability to you for any claim relating to BabyCheers is limited to the greater of the amount you paid us in the twelve months before the claim, or 50 USD.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep every right your local consumer law gives you, and nothing here takes those away.
11. Apple
You get BabyCheers through the App Store. This agreement is between you and us, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support for BabyCheers. If the app fails to conform to any applicable warranty, you may tell Apple and Apple will refund the purchase price, if any; beyond that, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo, and are not on any US Government list of prohibited or restricted parties.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you may also bring proceedings in your own country, and the mandatory consumer protections there still apply to you.
